These Terms of Service (“Terms”) apply when you visit, browse, purchase from, enquire through or otherwise use the Gabriella Luchini Jewellery website and online store, including any related products, services, content, features, tools and communications.
In these Terms, “we”, “us” and “our” refer to Gabriella Luchini Jewellery. “You” and “your” refer to the person using our website, placing an order, making an enquiry or purchasing from us.
Gabriella Luchini Jewellery is powered by Shopify, which enables us to provide our online store and related services.
By accessing or using this website, placing an order or engaging our services, you agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy, Returns & Exchanges Policy and any other policies or terms linked on our website.
If you do not agree with these Terms, please do not use our website or place an order.
1. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law or any other applicable consumer protection laws.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. If an item has a major problem, you may be entitled to a repair, replacement, refund or other remedy. If the problem is minor, we may choose to repair the item within a reasonable time.
Change-of-mind returns, exchanges or cancellations are not guaranteed unless expressly offered by Gabriella Luchini Jewellery in writing.
Where any part of these Terms conflicts with your rights under Australian Consumer Law, your rights under Australian Consumer Law will apply.
2. Access and Account
By using this website, you confirm that you are at least the age of majority in your state, territory or country of residence, or that you have the consent of a parent or guardian.
You may be asked to provide personal information when using our website, including your name, email address, billing details, payment details, shipping address and enquiry information.
You agree that any information you provide is accurate, current and complete. You are responsible for maintaining the confidentiality of your account details and for all activity that occurs under your account.
You must not use this website for any unlawful, misleading, harmful, fraudulent or unauthorised purpose.
3. Our Products
Gabriella Luchini Jewellery creates one-of-a-kind, ready-to-wear, made-to-order, custom, bespoke and ceremonial jewellery using precious metals and natural gemstones.
We make every effort to describe and photograph our products accurately. However, colours, scale, texture and appearance may vary depending on lighting, photography, screen settings and device display.
All product descriptions, pricing, availability and imagery are subject to change without notice. We reserve the right to discontinue, modify or limit the quantity of any product or service at any time.
Because many of our pieces are handmade, one-of-a-kind or made using natural materials, minor variations may occur and are part of the nature of the work.
4. Natural Gemstones and Handmade Variation
Gabriella Luchini Jewellery works with natural gemstones. Natural gemstones may contain inclusions, colour zoning, variations in tone, cut, shape, texture, growth patterns or other characteristics that form part of their individuality.
These natural features are not considered faults unless the item is significantly different from its description or does not meet applicable consumer guarantees.
Handmade jewellery may also show subtle variations in texture, finish, proportion or detail. These variations are part of the handmade process and are not considered faults unless the item does not meet applicable consumer guarantees.
We do our best to accurately represent each stone and finished piece, but we cannot guarantee that colour will appear exactly the same across all screens, photographs or lighting conditions.
5. Studio Stones
Studio Stones are natural gemstones offered as part of Gabriella Luchini Jewellery’s semi-custom process.
Each Studio Stone is unique and, unless otherwise stated, available only once. Once a Studio Stone has been purchased, reserved or committed to a commission, it may no longer be available to other customers.
Studio Stones may be shown with example sketches, renders or design directions. These are intended as visual guides only. Final design, proportions, pricing and technical details may vary depending on the chosen setting, metal, stone suitability and design requirements.
Any Studio Stone selected for a custom or semi-custom piece will be subject to the custom, bespoke and made-to-order terms below.
6. Orders
When you place an order, you are making an offer to purchase the selected product or service.
An order is not accepted until we have confirmed acceptance and received payment or the required deposit.
We reserve the right to accept, decline, cancel or limit an order for any reasonable reason, including but not limited to product unavailability, pricing errors, suspected fraud, incorrect information, payment issues, or circumstances outside our control.
If we need to cancel or make changes to an order, we will attempt to contact you using the email address, billing address or phone number provided at the time of order.
Please review your order carefully before submitting it. Once an order has been accepted, we may not be able to accommodate cancellation or change requests, especially for made-to-order, resized, altered, engraved, custom or bespoke pieces.
7. Custom, Bespoke and Made-to-Order Pieces
Custom, bespoke, semi-custom, made-to-order, resized, altered or engraved pieces are created specifically for you.
These pieces cannot be returned, exchanged or cancelled for change of mind once work has commenced, unless otherwise agreed in writing or required by law.
A custom or bespoke piece may involve consultation, design time, gemstone sourcing, sketches, renders, technical development, material ordering and studio labour. Any deposit paid may cover some or all of this work.
Once a design has been approved and work has commenced, cancellations may not be possible. Deposits may be non-refundable depending on the stage of the commission, to the extent permitted by law.
Requested changes after design approval may incur additional costs and may affect the timeline of your piece.
We reserve the right to decline a custom or bespoke commission if we do not believe the design, stone, material, budget, timeline or request is suitable.
8. Design Approval
For custom, bespoke and semi-custom pieces, you may be provided with sketches, renders, design notes, stone options, measurements or other visual references before making begins.
It is your responsibility to review all design details carefully before approval, including stone selection, metal choice, ring size, proportions, finish, engraving, design direction and budget.
Once you approve a design, we will proceed based on that approval.
Any changes requested after approval may be treated as a design variation and may incur additional fees.
Sketches and renders are visual guides only. The final handmade piece may vary slightly due to the making process, stone shape, material behaviour and technical requirements.
9. Heirloom Remodelling and Customer-Supplied Stones
Where suitable, Gabriella Luchini Jewellery may work with heirloom gemstones or customer-supplied stones.
All customer-supplied stones must be assessed before we agree to use them. We reserve the right to decline the use of any stone if we believe it is too fragile, damaged, unstable, unsuitable for the design, or unable to withstand the making or setting process.
Heirloom stones may carry existing wear, chips, abrasions, fractures, treatments, inclusions or other vulnerabilities that are not always visible before unsetting or making.
To the extent permitted by law, Gabriella Luchini Jewellery is not responsible for pre-existing damage, hidden weaknesses, unknown treatments, inaccurate third-party information or issues arising from the inherent fragility of customer-supplied stones.
We will take reasonable care when handling customer-supplied stones. If an issue arises, we will communicate with you as soon as possible.
Old gold is generally not reused directly in new Gabriella Luchini Jewellery pieces. Where suitable, old gold may be refined and credited towards the cost of a commission.
10. Ring Sizing
You are responsible for providing an accurate ring size.
We strongly recommend being professionally sized before ordering a ring, particularly for custom, bespoke, wide-band or one-of-a-kind pieces.
Some rings can be resized. Others may not be suitable for resizing due to the design, stone placement, metal, setting style or finish.
Resizing may incur an additional fee and may affect the appearance, finish or timeline of the piece.
If a ring is made to the size you provided and later requires resizing, this is generally not considered a fault.
11. Pricing, Quotes and Payment
All prices are listed in Australian dollars unless otherwise stated.
Prices, discounts, promotions and availability may change without notice. The price charged will be the price in effect at the time your order is placed, unless there has been an error.
For custom and bespoke pieces, quotes are prepared individually based on the design, gemstones, metal, scale, complexity and labour involved.
Unless otherwise stated, custom quotes are valid for 5 days due to fluctuations in material, metal and gemstone pricing.
A 50% deposit is generally required to begin custom, bespoke or made-to-order work, unless otherwise agreed in writing. The remaining balance must be paid before collection, delivery or shipment.
We are not required to release or ship any piece until payment has been received in full.
If a payment plan has been agreed, all payments must be completed before the piece is collected or shipped.
12. Payment Information
You agree to provide current, complete and accurate payment, billing and account information for all purchases.
You represent and warrant that you are authorised to use the payment method provided and that payment information supplied by you is true, correct and complete.
Payments may be processed by third-party providers, including Shopify Payments, Stripe, PayPal, Afterpay or other payment services made available at checkout.
Your use of any third-party payment service may be subject to that provider’s own terms and policies.
13. Taxes, Duties and Customs
Prices do not include shipping, customs duties, import taxes or other charges unless expressly stated.
For international orders, you are responsible for any customs duties, taxes, tariffs, import charges or fees imposed by your country.
We are not responsible for delays caused by customs, border processing or international postal services.
If an international order is returned to us due to unpaid customs charges, incorrect address information, refusal of delivery or failure to collect, additional shipping or handling charges may apply.
14. Shipping and Delivery
Delivery times are estimates only and are not guaranteed.
We are not responsible for delays caused by postal carriers, courier services, customs processing, public holidays, weather events, incorrect address details, industrial action, natural disasters or other circumstances outside our control.
We will assist where possible if an order is delayed, damaged or appears lost in transit.
You are responsible for providing a correct and secure delivery address. We are not responsible for orders delivered to an incorrect address supplied by you.

15. Returns, Exchanges and Cancellations
Returns, exchanges and cancellations are handled in accordance with our Returns & Exchanges Policy and your rights under Australian Consumer Law.
We do not guarantee returns, exchanges or refunds for change of mind.
Custom, bespoke, semi-custom, made-to-order, resized, altered, engraved or personalised pieces cannot be returned or exchanged for change of mind.
This does not affect your rights under Australian Consumer Law if an item has a major or minor problem, is not as described, or fails to meet a consumer guarantee.
If you believe there is an issue with your order, please contact us as soon as possible with your order number, a description of the issue and clear photographs where relevant.
16. Repairs, Wear and Care
Jewellery is delicate and should be worn with care.
Normal wear and tear, accidental damage, misuse, improper storage, exposure to chemicals, impact damage, loss of stones due to force, and damage caused by third-party repairs or alterations are not generally considered manufacturing faults.
We may offer repairs, resizing or maintenance services at our discretion. Fees may apply depending on the nature of the work, age of the piece and cause of the issue.
Any repair or alteration carried out by another jeweller may void any warranty, care arrangement or repair support offered by Gabriella Luchini Jewellery.

17. Gift Cards
If gift cards are offered, they are subject to the terms stated at the time of purchase.
Gift cards are not redeemable for cash and cannot be replaced if lost, stolen or used without permission, except where required by law.
18. Website Content
All content on this website is provided for general information and shopping purposes only.
We do our best to keep information accurate, current and complete, but we do not guarantee that all information on the website will always be error-free, complete or up to date.
We may update, correct or remove content at any time without notice.
19. Errors, Inaccuracies and Omissions
Occasionally, information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability, shipping charges, transit times or other details.
We reserve the right to correct any errors, inaccuracies or omissions, and to update information where required.
If a genuine error affects an order you have placed, we will contact you as soon as possible to confirm the correct details, offer an alternative where appropriate, or cancel and refund the affected item.

All content on this website, including text, images, photographs, graphics, designs, logos, product names, product descriptions, video, audio, branding, layout and overall design, is owned by Gabriella Luchini Jewellery or used with permission.
This content is protected by Australian and international intellectual property laws.
You may access and use the website for personal, non-commercial purposes only.
You must not reproduce, copy, modify, distribute, publish, transmit, display, sell, exploit or use any content from this website without our prior written consent.
This includes using our product images, jewellery designs, copy, sketches, renders or brand materials for commercial purposes, copying, manufacturing, AI training, imitation, resale or reproduction.

21. Custom Design Intellectual Property
All custom design concepts, sketches, renders, drawings, written design directions and technical development created by Gabriella Luchini Jewellery remain the intellectual property of Gabriella Luchini Jewellery unless otherwise agreed in writing.
Payment for a custom or bespoke piece does not transfer ownership of the underlying design process, sketches, renders, concepts or intellectual property.
You may not use our custom designs, sketches or renders to have a piece made by another jeweller without our prior written consent.
22. Photography and Portfolio Use
Gabriella Luchini Jewellery may photograph finished pieces for records, portfolio, website, social media, marketing or archival purposes.
We will not publish personal identifying information without consent.
If your piece is a surprise, confidential or intended for a specific date, please let us know in writing before collection or delivery so we can discuss timing around any public sharing.
23. Feedback, Reviews and Submissions
If you submit reviews, testimonials, feedback, photographs, suggestions or other content to us, you grant Gabriella Luchini Jewellery permission to use, reproduce, edit, publish and display that content for business, promotional, marketing and website purposes, unless otherwise agreed in writing.
You confirm that any content you submit is accurate, lawful and does not infringe the rights of any third party.
We may edit, remove or decline to publish any submitted content at our discretion.
